피고인은 2015년 3월부터 2018년 7월까지 피해자 B(여, 44세)과 사귄 사이로서, 2018. 12. 22. 00:00경 고양시 덕양구 C건물 D호 자신의 주거에서, 피해자가 다른 남자를 만나는 것에 화가 나 피해자에게 전화를 걸어서 “올해가 가기 전에 정리할 것이 있다”고 말하여 위 주거로 유인한 다음, 피해자에게 “너랑 섹스한 거 다 녹음해 놨다, 들려줄게, 들어볼래 이거 보내 볼까 네 서방이나 너를 아는 지인들에게 뿌려 볼까 ”라면서 협박하고, 주먹으로 피해자의 얼굴을 3회 때린 다음, 넘어진 피해자의 머리채를 잡아 일으켜 세워 다시 얼굴을 가린 피해자의 손등 부위를 여러 번 때리고, 이불 위에 쓰러진 피해자의 옷을 모두 벗기고 “너는 걸레 같은 년이니까, 걸레처럼 나랑 씹이나 하자, 섹스 친구나 하자”고 말하면서, 자신의 바지와 속옷을 벗어서 성기를 꺼낸 다음 “네가 세워라”고 말하면서, 자신의 성기를 피해자의 입안에 약 10회 넣었다가 빼기를 반복하고, 싱크대에 있던 식용유로 자신의 성기 및 피해자의 항문과 음부에 바르고 삽입을 시도하였으나, 성기가 발기되지 아니하여 실패하자, 다시 자신의 성기를 피해자의 입안에 넣고, 자신의 손가락을 피해자의 항문에 넣었다
