Reasons
1. In the first instance trial, the Plaintiff sought confirmation that the Plaintiff is the representative of the Defendant at the primary claim against the Defendant at the first instance trial, and the Defendant sought confirmation that the written resolution on August 30, 2013, which was issued on May 16, 2013, was null and void. The first instance court dismissed the primary claim and accepted the conjunctive claim.
This Court's appeal is limited to the conjunctive claim.
2. The court's explanation on the facts and the legal nature of the defendant's legal nature is the same as the corresponding part of the reasoning of the judgment of the court of first instance (as to No. 2, No. 5 and No. 6 of the judgment of the court of first instance). Thus, it is acceptable in accordance with Article 420 of the Civil Procedure Act.
3. In full view of the purport of each argument in the evidence Nos. 14 and 16 (including the number of branch numbers, and the following), the written consent at the time of the written consent of this case: “The amendment of the management rules of the building of this case and the additional consent”, “the consent to the ratification of the election of the executive of this case” and “the consent to the distribution of term deposits by the defendant” shall be affixed to the written consent of this case and shall express the consent. The seal box is not classified by each item, but is in one column. In fact, the 67 sectional owners of the building of this case submitted the written consent, and the 67 persons of the building of this case affix their seals or signatures only, without distinguishing each item from each item, in submitting the above written consent, only one of the above affixed seals or signatures, and the "the consent to the distribution of term deposits by the defendant" among the above three agenda items shall be distributed to the sectional owners of the building of this case which comes due on June 4, 2013.
