1. The Defendant’s KRW 46,782,285 as well as the Plaintiff’s KRW 5% per annum from November 15, 2017 to May 29, 2018.

1. Basic facts

A. On February 26, 2015, the Defendant awarded a contract to D on February 26, 2015, for the construction of multi-family houses (hereinafter “instant building”) with the size of 4th above the ground level E in Suwon-gu, Suwon-si, Suwon-si (hereinafter “C”) owned by the Defendant to KRW 385,000,000 for the cost (i.e., the expected construction area of approximately 100 square meters x the unit price of KRW 3,850,000 per square year).

B. On February 17, 2016, D et al. drafted a power of attorney to delegate all the powers to the Plaintiff regarding the payment of the remainder after deducting the amount paid as construction cost from the aforementioned construction cost of KRW 385,00,000. On the same day, D et al. stated the purport that the Defendant’s husband and the agent F would pay the remainder after deducting the aforementioned amount from the construction cost to the Plaintiff.

C. On February 23, 2016, F, on behalf of the Defendant, had the Plaintiff carry out an additional construction on the first floor facilities and the third floor partitions of the instant building, and the construction cost of KRW 20,000,000,000, is written with an agreement to receive and pay as security upon the completion of the building.

With respect to the instant building, the approval for use was made on March 17, 2016.

E. F: (a) On behalf of the Defendant, KRW 285,200,000 for the Plaintiff on April 8, 2016 (=the construction cost of KRW 385,00,000 for the instant construction cost of KRW 20,000 for the additional construction cost of KRW 20,000 for the multi-story facilities and the third-story partitions for the instant construction cost of KRW 113,00,000 for the prepaid construction cost of KRW 113,000 for D (= the prepaid construction cost of KRW 3,00,000 for February 26, 2015)

2. 10,000,000 won; and

3. 20,000,000 won; and

3. 30,000,000 won; and

3. 31. 50,000,000) - Payment of the purification tank construction cost of KRW 6,800,000 shall be paid, and the Defendant’s additional payment note was made to deduct the above payment from the above payment (hereinafter “instant payment note”).

F. D) around April 8, 2016, the Defendant agreed to the instant construction cost of KRW 385,00,000 and paid KRW 113,00,000 from the Defendant until March 31, 2015, but did not comply with the Defendant’s promise.
