1. The instant lawsuit was concluded on April 8, 2015 as deemed the withdrawal of the lawsuit.

Reasons
Article 158 of the Civil Execution Act provides that when a person who has raised an objection to a distribution fails to appear on the first date for pleading of a lawsuit of demurrer against distribution, the revocation of the lawsuit shall be deemed to have been made, and where it is found that the lawsuit has been excessive and that the trial has been continued, the court shall ex officio make
(2) The Plaintiff did not appear at the first date for pleading of this case on July 30, 2014, and filed a lawsuit of demurrer against the Defendant on August 4, 2014. The court designated the first date for pleading as 11:20 on April 8, 2015 and sent a notice of the date for pleading to the Plaintiff on March 19, 2015. The Plaintiff did not appear at the court on March 20, 2015, and the Plaintiff did not appear at the first date for pleading of this case on March 20, 2015, and the Plaintiff did not appear at the first date for pleading of this case on July 30, 2014, and the Plaintiff did not appear at the court on May 20, 2015, and the Plaintiff did not appear at the first date for pleading of this case on March 20, 2015. The Plaintiff did not appear at the first date for pleading of this case on May 13, 2015.
If so, it is so decided as per Disposition by the declaration of termination of the lawsuit in this case.
