1. The Defendants jointly share KRW 245,950,172 to the Plaintiff and Defendant Specialized Construction Mutual Aid Association on May 5, 2016.
Reasons
. Accordingly, on April 30, 2015, the Plaintiff and Defendant Jinjin Construction agreed to settle the final settlement amount of the instant first subcontract as KRW 3,544,200,000 on the ground that the primary construction pursuant to the instant first subcontract was completed.
3) In addition, on March 26, 2015, the Plaintiff’s second subcontract agreement with Defendant Jinjin Construction (hereinafter “instant second subcontract agreement”) with the following contents.
1.Orderer: The name of the original contract of the Busan Regional Land and Transport Administration (Ministry of Land, Transport and Maritime Affairs): ancient-HabIC (3 national highways construction works).
2. The name of subcontracted construction: Earth and reinforced concrete construction work (2 tea);
3. The construction site: the site of construction works on the national highways of ancient- Staff (3).
4. Period: (Commencement of Construction) December 31, 2015;
5. Contract amount: The supply price of KRW 2,984,300,000 for Japan: KRW 2,984,300,0000 for Japan: KRW 2,713,000,0000 for Japan ( KRW 2,713,00,000): KRW 300,000 for Japan, KRW 954,976,000 for KRW 30,000 for KRW 30,000 for KRW 30,000 for KRW 300,000 for KRW 300,000 for KRW 30,000 for KRW 30,000 for KRW 30,000 for KRW 1,769,724,000 for contract amount, KRW 294,300 for 20,300,000 for 315,205,015,000 National Housing Association (hereinafter referred to as the “Industrial Housing Association”) for 2136,25,25,015.
(2) On May 6, 2015, in order to guarantee the payment of the Plaintiff’s obligation to return advance payment to the Plaintiff of Jinjin Construction, the following terms and conditions of the guarantee agreement for advance payment (hereinafter “instant guarantee agreement”).
(5) Around that time, Defendant Jinjin Construction filed an application for advance payment with the Plaintiff, a guarantee creditor, while delivering the said advance payment guarantee to the Plaintiff. On May 18, 2015, the Plaintiff filed the instant application for advance payment with Defendant Jinjin Construction with KRW 300 million or less.
