Reasons
1. Basic facts
A. The defendant is a corporation established pursuant to Article 8 of the Legal Aid Act, which has 18 branches and 41 branches nationwide.
On April 1, 2007, the plaintiff was appointed to the defendant, and has been paid wages as an affiliated attorney-at-law by providing labor on the legal aid services.
From April 1, 2007 to February 24, 2009, the Plaintiff is the director of B Branch Office acting as the director of B Branch Office, from February 25, 2009 to February 16, 2014, from February 17, 2014 to April 5, 2015, as C Branch Office’s affiliated attorney-at-law, from April 6, 2015 to February 21, 2016, as C Branch’s structural director, from February 22, 2016 to February 26, 2017, and from February 27, 2017, as E Branch.
B. 1) On July 20, 2018, the Defendant issued a personnel order for affiliated attorneys-at-law on August 16, 2018, and for the Plaintiff, the head of E branch office gives a personnel order to transfer the Plaintiff to the head of E branch office of E branch office (hereinafter referred to as “first appointment order”).
(2) On July 25, 2018, the Plaintiff filed an application with this court for provisional disposition, such as seeking the suspension of validity of the preceding transfer order (2018Kahap10020), with the Defendant as the other party (hereinafter referred to as the “Defendant”), and filed a lawsuit seeking confirmation of invalidity of the preceding transfer order with this court on August 8, 2018.
(2) On August 13, 2018, this Court rendered a decision to suspend the validity of the preceding order until the issuance of the main text of the lawsuit on the preceding order, on the ground that the preceding order has the right to seek confirmation of invalidity of the preceding order and the need for preservation is recognized, since the preceding order has been transferred to the Plaintiff without good cause or has abused personnel rights. (4) On August 14, 2018, this Court revoked the preceding order to the Plaintiff, and the Plaintiff committed a tort against the Plaintiff.
