Reasons
Punishment of the crime
"The past record of crime" / [the past record of the 2017 Highest 666] Defendant was sentenced to a suspended sentence of two years for six months in imprisonment for fraud in the original state support of the Chuncheon District Court on November 11, 2015, and the above judgment became final and conclusive on November 19, 2015, during the suspended sentence period.
[Criminal facts]
1. Around June 7, 2016, the defrauded: “C” located on the fourth floor of the building B located on the second floor of the building B in Won-si, Seoul; “The Defendant seeks to operate the Fluice Center on the second floor of the building B; “The payment of KRW 10 million on June 29, 2016; KRW 100 million on July 15, 2016; and KRW 60 million on July 29, 2016; and the Defendant was operating a studio in Seoul with the same business.” The Defendant concluded a construction contract with the victim by stating that “The payment of the construction cost shall be made as monthly dividends; and the construction cost shall be paid as the monthly dividends.”
However, in fact, the Defendant did not have any particular income at the time and did not have any property, and there was no possibility of paying the construction cost, and as such, the Defendant did not receive dividends as well as there was no fund to operate the above insignia center, and thus, the Defendant did not have any intent or ability to pay the price even if he had the victim do so, as above, even if he did not have to do so.
Nevertheless, the defendant deceiving the victim as above and let the victim do so about KRW 140,000,000,000, and did not pay KRW 90,000,000, and did not acquire property benefits equivalent to the same amount.
2. On July 27, 2016, the Defendant damaged the property by removing a banner of an amount equivalent to KRW 400,000 from the market price owned by the victim D, posted at the second floor Nice Center of the building B in Gangwon-si, Gangwon-si, Seoul Special Metropolitan City.
"The defendant of 2018 Highest 861" was the victim E at the mutual coffee shop located in the Ma-dong-dong of the original city around January 2, 2017.
