If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

The defendant is a person who is delegated with all development activities on the above land by F, who is the owner of Ansan-si B, C, D, or E.

1. Any person who intends to change the form and quality of land violating the National Land Planning and Utilization Act shall obtain permission from the competent authorities;

Nevertheless, the Defendant, without obtaining permission from the competent authority from March 2012 to August 2012, 201, cut 730 square meters out of B 6,089 square meters prior to Ansan-si, C forest land 6,525 square meters, D forest land 6,018 square meters, E forest land 729 square meters, and E forest land 12,718 square meters.

Accordingly, the Defendant changed the form and quality of land without obtaining permission from the competent authorities.

2. Any person who intends to divert a mountainous district in violation of the Mountainous Districts Management Act shall obtain permission from the competent administrative agencies;

Nevertheless, the Defendant, without obtaining permission from the competent authority from March 2012 to August 2012, 201, cut 730 square meters out of B 6,089 square meters prior to Ansan-si, C forest land 6,525 square meters, D forest land 6,018 square meters, E forest land 729 square meters, and E forest land 12,718 square meters.

Accordingly, the Defendant diverted mountainous districts without obtaining permission from the competent authorities.

3. Any person who intends to change the form and quality of land in a forest protection zone in violation of the Forest Protection Act shall obtain permission from the competent authority;

Nevertheless, the Defendant, without obtaining permission from the competent authority from March 2012 to August 2012, 201, cut off 730 square meters out of B 6,089 square meters in Ansan-si, B, 6,525 square meters in C forest land, 729 square meters in D forest land 6,018 square meters, and 730 square meters in E forest land 12,718 square meters.

Accordingly, the defendant changed the form and quality of land in the forest conservation zone without obtaining permission from the competent authorities.

4. Any person who intends to erect a retaining wall, etc. to create a site in violation of the Building Act shall report it to the competent authority.

Nevertheless, the Defendant did not report to the competent authority, and installed a reinforced soil retaining wall of 403 meters in length from March 2012 to August 2012.
