1. The defendant shall pay 58,717,300 won to the plaintiff and 12% per annum from August 6, 2020 to the day of complete payment.

As to KRW 58,717,300, the Plaintiff sought payment of damages for delay calculated at the rate of 12% per annum from the delivery date of a copy of the instant complaint to the date of complete payment. However, Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings provides that the interest rate of 12% per annum from the day following the delivery date of the complaint shall be applied. Thus, the part of the claim for damages for delay on the delivery date
