1. The Defendant’s KRW 44,423,50 for the Plaintiff and KRW 6% per annum from August 10, 2018 to December 5, 2019.
Reasons
1. Basic facts
A. The Plaintiff is a corporation with the purpose of real estate sales agency, etc., and the Defendant is a corporation with the purpose of the construction business such as commercial buildings and housing, etc., which is the operator of the original city C building (hereinafter “instant commercial building”).
B. On November 14, 2016, the Plaintiff and the Defendant concluded a sales agency contract for the instant commercial buildings (hereinafter “instant contract”) with the following content.
Article 2 (Scope of Business Affairs) A (referring to the defendant; hereinafter the same shall apply) shall, at the same time as the contract of this contract is entered into, grant to B (referring to the plaintiff; hereinafter the same shall apply) all rights to sell the subject-matter, and shall not grant a third party authority to sell the subject-matter without the written consent of B.
Article 7 (Commission for Sale by Proxy) 5% of the fee for item 5% per second floor.
