A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2019. 11. 7. 16:40경 파주시 B에 있는 상호를 알 수 없는 음식점에서 술을 마시다가 술에 취한 상태로 아무 이유 없이 옆 테이블에 앉아 있는 손님에게 욕설을 하며 시비를 걸고, 같은 날 16:44경 위 음식점 앞에서 ‘술집인데 옆 사람이 시비를 건다. 욕하고, 흉기 없음’이라는 112신고를 받고 출동한 파주경찰서 C지구대 소속 경사 D(36세)가 신고 경위를 확인하고 신고자와 말다툼 중인 피고인을 신고자와 분리시킨 다음 피고인의 진술을 청취하려고 하자 위 D에게 “가세요, 재미있네”라고 말하고, 위 D로부터 “못가요, 우리는 선생님, 법을 집행하고 법에 써 있는대로 하는데 뭐가 재밌나요, 난 재미없는데, 이게 재미있나”라는 말을 듣자 위 D에게 “어디서 반말을”이라고 말하며 오른손으로 위 D의 왼쪽 얼굴 부위를 1회 때려 폭행하였다.
