A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. Around 09:30 on August 10, 201, the Defendant made a false statement that “If the Defendant borrowed KRW 5,000,000 to the said victim under his/her name, he/she shall do business, and he/she shall pay interest, etc. within six months.”

However, the fact was that the defendant did not specifically operate his business at the time and did not generate business profits, and even if he did not have any financial standing to approximately KRW 700-8,000,000,000 and borrowed loans from the victim, there was no intention or ability to repay it.

As such, the Defendant, by deceiving the victim as such, acquired 5,00,000 won from the victim's name from the victim to the third party.

B. On August 09, 201, the Defendant made a false statement to the said victim that “The Defendant would pay all of the premium payments in the face of SM7 in the name of SM7 high vehicle” in the cross-displacer shop located in the Daegu East-gu Inspection Station.

However, it is true that the above payment is made in bad financial standing.
