Defendant shall be punished by a fine of KRW 4,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The Defendant is the representative director who actually operates the “C” corporation established for the purpose of real estate development business, etc. in Daegu-guned Zone B.

On May 28, 2009, the Defendant, at the Defendant Company’s office in the Daegu-gun B third floor, made a contract for the construction work with the complainant D, first to settle the remainder after the completion of 30% in the middle of the construction work, and then promised to pay the remainder after the completion of 30% in the middle of the construction work. “Public mission: E: the construction work period from May 28, 2009 to June 6, 2009: the construction work amount: 13,470,60 won: 20% in the start payment, intermediate payment 20% in the intermediate payment, and 60% in the remainder.”

However, the defendant did not have the intention or ability to pay the construction cost even if the defendant requested the interior work.

As such, the Defendant, by deceiving the complainant, had the complainant complete the aforementioned interior work from that time until June 5, 2009, and by failing to pay the construction cost of KRW 13,470,600, the Defendant acquired pecuniary benefits equivalent to the amount of money.
