Punishment of the crime

On June 2012, the Defendant made a false statement to the victim C, stating that “I will make aground every year with the interest of 0.4% of the amount invested every month, along with the interest of 0.4% of the amount of investment every month through the purchase of electronic equipment and parts where I would make a lot of investment if I would make a lot of investment in the electronic equipment business.”

However, at the time, the Defendant was not in contact with one’s own children or children at the time, and was thought not only to conduct electronic equipment business but also to use money as gambling funds to the victim. Therefore, even if the Defendant borrowed money from the victim, there was no intention or ability to pay the money by investing in the electronic equipment business.

The defendant deceivings the victim as such, and causes the same damage to the victim.

On December 24, 2012, the Plaintiff was authorized to use the passbook and e-mail card connected to the No. Masp Loan Account (E) in the name of the victim, the passbook and e-mail card connected to the No. Masp Loan Account (F) in the name of the victim, the maximum loan limit of which is KRW 95 million, and the passbook and e-mail card connected to the No. Masp Loan Account (G) in the name of the victim, and the passbook and e-mail card connected to the No. Masp Loan Account (F) in the name of the victim, the maximum loan limit of which is KRW 100 million.

Accordingly, the Defendant, by deceiving the victim, acquired financial benefits equivalent to 250 million won, which is the sum of the lending limit of the said Malp loan account by deceiving the victim.
