Reasons
Punishment of the crime
The Defendant and B are those who worked as the head of the entertainment drinking house office in Yeongdeungpo-gu, Chungcheongnam-gu, Cheongju-si, and D were those who worked as an employee of the entertainment drinking house.
1. On September 16, 2017, the Defendant and D’s co-principal Defendant and D made a false statement to the victim F that “If they lend KRW 5 million to the victim F, they will repay the principal amount plus KRW 500,000,000,000 to KRW 6,50,000,000 per 10,000 won per 10,000 won per month,” and the Defendant made a false statement to the victim that “I will jointly and severally guarantee D’s obligation.”
However, the Defendant and D have been thought to divide money from the victim, and at the time, the Defendant had already been liable for a debt amounting to approximately KRW 2.5 million, and at the time, the Defendant borrowed money from the bond company, and was in the situation where he borrowed money from the bond company, and D had no intention or ability to pay the money normally even if he borrowed money from the victim.
Ultimately, the Defendant, in collaboration with D, by deceiving the victim as above, received 4,350,000 won, excluding 6,50,000 won in the name of the principal and interest at one time, from the victim’s location, from the KEB but bank account (Account Number: G).
2. On September 28, 2017, the Defendant and B made a false statement to the effect that, within the mobile phone sales store of the victim F of the victim’s operation in Heung-gu, Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu, and that, “If the victim loans KRW 5 million to the victim, the principal and the interest KRW 500,000 shall be plus the principal and interest KRW 1,50,000,000 for each 10th day of each month, 650,000,000.” The Defendant made a false statement to the victim that “The Defendant will jointly and severally and severally guarantee the victim’s obligation
However, the defendant and B thought that they share the money by lending it from the victim.
