1. The Defendant’s disposition of business suspension of 1.5 months against the Plaintiff on March 31, 2020 shall be revoked.

2. The costs of the lawsuit are assessed against the defendant.

1. Details of the disposition;

A. On January 13, 2020, the Plaintiff, as a licensed real estate agent, arranged a single house sales contract jointly with B.

B. On the same day, the Plaintiff prepared and signed and sealed a confirmation description of the object of brokerage and delivered it to the seller and the buyer. The Plaintiff omitted the joint intermediary B’s seal in the confirmation description of the object of brokerage (hereinafter “instant description”) issued to the buyer.

C. On March 31, 2020, the Defendant rendered a disposition of business suspension 1.5 months to B pursuant to Article 39(1)7 of the Licensed Real Estate Agents Act (hereinafter “Act”) on the ground that “Joint Broker B did not affix the seals to the instant explanatory note,” and issued a disposition of business suspension 1.5 months (hereinafter “instant disposition”) to the Plaintiff.

2. The grounds and relevant laws and subordinate statutes are as stated in the relevant laws and regulations, and among them, the underlying laws and regulations are as follows.

▣ 공인중개사법 제25조(중개대상물의 확인ㆍ설명) ④ 제3항의 규정에 의한 확인ㆍ설명서에는 개업공인중개사(법인인 경우에는 대표자를 말하며, 법인에 분사무소가 설치되어 있는 경우에는 분사무소의 책임자를 말한다)가 서명 및 날인하되, 당해 중개행위를 한 소속공인중개사가 있는 경우에는 소속공인중개사가 함께 서명 및 날인하여야 한다.

Article 39 (Suspension of Business) (1) Where a practicing licensed real estate agent falls under any of the following subparagraphs, the registration authority may order the suspension of business for a fixed period not exceeding six months:

In such cases, a practicing licensed real estate agent who is a juristic person may be ordered to suspend his/her business for each juristic person or branch office.
