The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal is unreasonable because the penalty of the lower judgment (two million won of a fine) is too unhued.

2. In full view of the facts that the amount of damage is limited to KRW 240,00,00, the agreement with the victim is reached, the defendant appears to recognize and reflect his mistake, and the fact that it appears to be the cause of the instant crime, and all matters regarding the sentencing specified in the records and arguments of the lower judgment are determined as appropriate, and thus, the prosecutor’s assertion is without merit.

3. Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
