1. The defendant shall pay each of the corresponding money stated in the "sale price" list of the execution details of the attached sales contract from the plaintiff.
Reasons
1. Basic facts
A. The Plaintiff is a reconstruction association established for the purpose of removing the housing, etc. within the Nam-gu Seoul Metropolitan Government Housing Construction Promotion Act (hereinafter “instant project zone”) and constructing new housing, etc. on the site pursuant to the former Housing Construction Promotion Act (wholly amended on May 29, 2003; hereinafter the same shall apply) and upon authorization for the establishment of a new housing, etc. on June 27, 2003 and authorization for the implementation of a project on July 12, 2017. The Defendant is a person who owned and owned each of the pertinent real estate indicated “real estate indication” in the attached sales contract statement in the instant project zone (hereinafter “each of the instant real estate”).
B. On July 31, 2017, the Plaintiff filed an application for authorization to change the number of union members to 106 persons (excluding State-owned and public-owned land property management authorities among 109 persons) pursuant to Article 16(2) of the former Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (wholly amended by Act No. 14567, Feb. 8, 2017; hereinafter “former Act”) on the ground that “the Plaintiff obtained consent from 143 landowners, etc. in the instant rearrangement zone,” and obtained authorization to change the number of union members on August 30, 2017 (hereinafter “the authorization to change the establishment of the instant case”).
C. The Plaintiff, such as notification of the application for parcelling-out, notified the Defendant of the application for parcelling-out from August 31, 2017 to October 15, 2017 (the first date, October 2, 2017, and the first date, October 2, 2017). The Defendant did not file an application for parcelling-out.
The relevant provisions of the articles of incorporation of the Plaintiff Union are as follows.
(4) Where a member of the cooperative falls under any of the following subparagraphs, the cooperative shall liquidate the building and other rights in cash within 150 days from the date on which he/she falls under any of the following subparagraphs:
1. An applicant for parcelling-out;
2. Persons who have withdrawn the application for parcelling-out;
3. An approved management and disposal plan.
