A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

1. 상해 및 업무방해의 점 피고인은 2019. 8. 8. 22:50경부터 23:20경까지 사이에 부산 부산진구 B에 있는 피해자 C(31세) 운영의 ‘D’ 주점에서, 피고인과 동석하고 있던 일행 E이 기분 나쁜 이야기를 하였다는 이유로 큰소리로 욕설을 하고, 이에 위 피해자가 피고인에게 다가 가 시끄러우니 자제해 줄 것을 당부하자 화가 나 손으로 피해자의 머리채를 잡아 약 30초간 흔들고, 주변의 손님들과 피해자에게 “뭘 쳐다보냐”, “칼 가지고 와서 너를 죽여 버릴거다”라고 고함을 치고, 자신이 앉아 있던 탁자와 주변의 다른 탁자들에 놓여 있던 소주잔과 맥주잔을 손으로 쓸어 밀어서 바닥으로 떨어뜨려 깨뜨리는 등 약 30분 간 소란을 피웠다.

As a result, the defendant injured the victim about two weeks of medical treatment, and interfered with the victim's main business by force.

2. On August 8, 2019, at around 23:30 on August 23, 2019, the Defendant: (a) 112 reported to the effect that there was a person frighting down at the main place; and (b) G police officers belonging to the F District District of the Busan Jin-gu Police Station who called the scene after receiving a 112 report to the effect that his body fighting took place; and (c) she was spited one time at the right side of the above G while hearing the Defendant’s statement of damage from the F District of the Busan Jin-gu Police Station, the main place of business; (d) the Defendant informed the Defendant of the police officer’s status; and (e) was spited one time on the right side of the face of the said G.

Accordingly, the Defendant interfered with the legitimate execution of duties by police officers concerning the handling of 112 reported cases.

3. The Defendant was arrested as a flagrant offender in the vicinity of the main station of the “D” around August 8, 2019, around 23:50, and as such, the Defendant was arrested as a flagrant offender.
