1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. On March 1, 1978, the Plaintiff was appointed as Staff Sergeant on August 19, 1978 and was discharged from military service on March 31, 198.

After that, on May 1, 1985, a civilian military employee was appointed as a civilian military employee and voluntarily retired on May 30, 2012.

B. The Plaintiff was awarded the National Security Medal on July 31, 2012 as retirement rewards.

C. Details of the 2012 Government Rewards Guidelines relating to retirement rewards for military personnel and civilian employees (hereinafter “instant Guidelines”) are as follows:

▣ 훈격결정 훈장 : 재직기간이 33년 이상인 자중 공무원과 사립학교 교원, 별정우체국 직원 등은 근정훈장을, 군인 및 군무원은 보국훈장을 다음과 같은 기준에 따라 훈격을 결정함 훈종/훈격 1등급 2등급 3등급 4등급 5등급 비고 보국훈장 통일장 국선장 천수장 삼일장 광복장 군인 대장 중장 소장, 준장 영관급 위관급 이하 계급 군무원 - - 1급 2~4급 5급 이하 직급 포장 : 재직기간이 30년 이상 33년 미만인 자로서 공무원, 사립학교 교원 및 별정우체국 직원 등은 근정포장을, 군인 및 군무원은 보국포장을 수여함 ▣ 재직기간 합산대상 및 산정방법 공무원경력 : 국가공무원법 제2조 및 지방공무원법 제2조의 규정에 의한 공무원으로 재직한 기간 군인(군무원 포함)으로 근무하다가 전역 후 군인(군무원 포함) 이외의 공무원으로 임용되어 근무하고 퇴직하는 경우, 군인(군무원 포함)으로 근무한 재직기간은 전부 산입 각군사관학교, 제3사관학교 등 군양성 교육경력은 기간의 1/2을 재직기간에 산입 (군인퇴직에 한함)

D. On August 2017, the Plaintiff received a civil petition from a civilian military employee to the effect that, at the time of a retirement reward, all of the training period for the staff sergeant or one-half should be included in the tenure of office. On August 18, 2017, the Defendant sent a notice of guidance on the results of the treatment of civil petitions as follows to the Plaintiff.
