[Defendant A] The defendant shall be punished by imprisonment for eight months.

Punishment of the crime

[2015 Highest 4752] - No one who violates the Electronic Financial Transactions Act by Defendant A shall take over any access medium used to give instructions in electronic financial transactions or to secure the authenticity and accuracy of users and details of transactions, unless otherwise specifically provided for in other Acts.

On February 6, 2013, at the B office located in Guro-gu Seoul Metropolitan Government H 1309, the Defendant received from Kwikset service the access media, such as the passbook (Account Number: K, L, M) and three physical cards, OTP, Internet banking ID and its password.

In addition, from around February 2013 to March 2014, the Defendant acquired the medium of access to electronic financial transactions related to eight accounts, such as the attached list 5 in the list of crimes.

[2015 order 7457 [Attachment 7457] - Defendant C’s violation of the Electronic Financial Transactions Act was sentenced to imprisonment on November 21, 2014 by the Seoul Eastern District Court on January 30, 2015 and the judgment became final and conclusive on January 30, 2015.

Except as otherwise expressly provided for in any other Act, no access medium used to issue a transaction instruction in electronic financial transactions or to secure the authenticity and accuracy of users and the details of such transaction shall be transferred or taken over.
