Defendant
A shall be punished by imprisonment with prison labor for eight months and by a fine of eight million won, by imprisonment with prison labor for one year and by a fine of ten million won.
Reasons
Punishment of the crime
1. The Defendants - Defendant A is a person operating a commercial sex acts business with the trade name “E”, and Defendant B is a person who manages the business on behalf of the Defendants and receives half of the profits on the day when the Defendant A manages the business.
The Defendants: (a) from June 5, 2016 to June 17, 2016, with F having the head of the office F, directed male customers, such as J and K, to the above officetel; (b) (However, Defendant B was working on June 11, 2016; (c) June 12, 2016; and (d) June 17, 2016; and (c) leased Nos. 520, 726 of Gangseo-gu Seoul Metropolitan Government Gtel (F were working on June 17, 2016) to instruct male customers, such as L and M, waiting at the above officetel, and provided them with similar sexual intercourse with male guests or similar sexual intercourse after having them receive 1.5 million won or 3 million won from male customers.
Accordingly, the Defendants conspired with F to commit acts such as arranging commercial sex acts.
2. Defendant B’s sole criminal conduct of Defendant B – “2016 high-class 4370, leased No. 2608, the name of “O” and advertised the said establishment on the Internet website, such as “P,” and employed employees Q (the age of 30). On March 22, 2016, Defendant B arranged the commercial sex acts from around March 15, 2016 to around March 22, 2016, by having Q Q receive KRW 1.50,000 won in return for commercial sex acts from the customer R, and let Q take the form of sexual organ and scambling it.
3. Defendant B’s sole criminal conduct - Defendant B’s act of arranging sexual traffic with the trade name “U” on the Internet site, such as “T” after renting the office of heading 710, 1301, and 1401 of Mapo-gu Seoul Metropolitan Government Stel 710, 1301, and Defendant B’s act of arranging sexual traffic was under control, the second half of April 2016 is above.
