A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. From May 2015 to October 1, 2015, the Defendant entered into a sales contract for two kinds of officetels in the revenue-type officetels “B hotel” model office in Songpa-gu Seoul Metropolitan Government (B hotel) as the team leader belonging to the E, who was awarded a subcontract for the sales agency by the Plaintiff, while performing the sales agency business, and entered into a sales contract for two copies of officetels with the victim F.

On July 3, 2015, the Defendant: (a) around July 3, 2015, entered into a contract with the victim for the sale of two "B hotel" units, which is a profit-type officetel through this low price; (b) additionally, if the Defendant paid KRW 150,085,00,000 for the sale price in cash, the remainder of the sale price can be resolved through the guarantee of the construction company for the payment of the intermediate payment by the financial institution; and (c) there is no additional cost in addition, the Defendant would receive and sell the balance and the purchase will be made in the middle of the purchase, and if the person wishes to purchase the balance and the purchase by the occupancy date, it would be absolutely damaged by receiving the name of the director of the low-income sales company in the name of the director of the sales company.

However, if the purchase and sale is not made by the balance and the occupancy date, the company's director was not transferred under the name of the company for sale, and the defendant was made a false statement to receive incentives paid by the selling company for 3.5 million won per unit selling company. Thus, even if the victim entered into an additional sale contract, the victim did not have any intention or ability to cause damage to the victim.

Nevertheless, the defendant deceivings the victim as above and belongs to it.
