피고인들 및 D, E은 2013. 2. 22. 02:10경 화성시 I에 있는 J식당에서 피해자 F(31세), 피해자 G(31세), 피해자 H(31세)와 화성ㆍ오산지역의 노점상 자리 문제에 대하여 이야기를 하면서 함께 술을 마시다가 D이 피해자 F의 머리를 쓰다듬자 피해자 F이 인상을 쓰면서 “아저씨 왜 머리를 만져요.”라고 짜증을 냈다는 이유로, E은 “야 싸가지 없는 새끼들아, 삼촌뻘 되는 사람한테 뭐하는 짓이야.”라며 테이블을 엎으면서 피해자 G의 얼굴 부위를 주먹으로 1회 때리고, 피고인 A은 피해자 F의 얼굴 및 몸 부위를 주먹으로 수회 때린 후, 테이블 위에 놓여 있는 위험한 물건인 맥주병을 집어 들고 피해자 F의 머리를 1회 내리치고, 이에 합세한 피고인 B은 피해자 F의 얼굴 및 몸 부위를 주먹으로 수회 때리고, 같은 자리에서 D은 피해자 H의 얼굴 부위를 주먹으로 수회 때리고, 계속하여 위 식당 밖에 있던 E은 재차 피해자 G의 얼굴 부위를 주먹으로 4~5회 때리고 발로 수회 걷어차고, 이에 가세하여 피고인 A은 피해자 G의 뒤통수를 발로 1회 걷어차고 주먹으로 옆구리를 수회 때리고, 피고인 B은 피해자 G의 얼굴 및 몸통 부위를 주먹으로 수회 때려 위 G을 땅바닥에 쓰러뜨리고, 이어 D은 땅바닥에 쓰러진 피해자 G의 몸통 부위를 발로 2~3회 걷어찼다.
