1. The plaintiff's claims against the defendants are all dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Facts of recognition;

A. As to the Defendants, the Seoul Medical Center in Seoul Special Metropolitan City (hereinafter “Defendant Medical Center”) and the Defendant Educational Institute in the Korea Educational Institute operating the Korea Educational Institute (hereinafter “Defendant Educational Institute”) concluded an industry-academic cooperation agreement with the Plaintiff, and the Defendant Educational Institute agreed to assign the Defendant Medical Institute with a nurse training for the students affiliated with the said university at the request of the said university.

Defendant B, as the above university student, provided nurse practice at the Defendant Medical Center in accordance with the above agreement.

B. On March 20, 2014, at around 06:00, the Plaintiff: (a) was provided with pains to the first floor of the first floor underground of the Defendant Medical Center; (b) was provided with care to the emergency room on the first floor above the Defendant Medical Center; and (c) was seated with the elevator driven by the Defendant B, and was moved to the first floor of the first floor.

Defendant B, after the Plaintiff’s wheel chairs was pushed back to the elevator, opened the inner upper floor of the right side of the wall in the presence of the elevator door, and then opened the wheelchairs in the right side of the Plaintiff to look at the door.

그 순간 원고의 왼쪽 발 새끼발가락 쪽 측면이 엘리베이터 내부 좌측 벽면에 부딪히며 왼쪽 발목이 안쪽 방향(휠체어 회전 방향과 반대인 오른쪽 방향)으로 꺽이는 사고가 발생하였다.

가. 원고의 주장 요지 피고 B는 간호실습생으로서 휠체어로 환자를 이동시킴에 있어 엘리베이터를 탔으면 문이 열리는지 예의주시하여 문이 열리면 신속하게 휠체어를 밀고 나와야 할 주의의무가 있음에도, 문이 열린 사실도 모른 채 있다가 이를 뒤늦게 발견하고 급히 내리기 위해 갑자기 휠체어를 문 쪽을 향해 세게 돌리는 바람에 원고의 왼쪽 다리가 엘리베이터 벽면에 걸려 꺽이게...
