1. The Plaintiff:
A. Defendant B’s KRW 215,00,000 and interest rate of KRW 20% per annum from April 2, 2014 to the date of full payment.
Reasons
1. Facts of recognition;
A. The Plaintiff is a party’s position 1) On March 5, 2008, the Plaintiff is a party’s G building in Bupyeong-gu, Seocheon-gu (hereinafter “G building”) from F, the private village around March 5, 2008.
(2) Defendant D is a licensed real estate agent who registered his/her business under the trade name “H Licensed Real Estate Agent Office (hereinafter “H”) from October 14, 201 to June 17, 2013, and Defendant E is a licensed real estate agent who registered his/her business under the trade name “I Licensed Real Estate Agent Office (hereinafter “I”)” from January 18, 201 to August 20, 2013, and Defendant B was registered as an I brokerage assistant from June 26, 2012 to May 27, 2013, but also worked as H’s brokerage assistant.
3) Defendant C, as an actual operator of H, leased G building 202 from F on April 4, 2012 to operate H on the said building, and transferred the said building’s place of business to G building 307 on June 17, 2013. 4) Defendant D concluded a mutual aid agreement with the Defendant Korea Licensed Real Estate Agent Association (hereinafter “Defendant Association”) on October 14, 201 pursuant to the Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions Act (hereinafter “Real Estate Agents Act”), setting the amount of mutual aid as KRW 100,000,000, which caused property damage to a transaction party due to intentional or negligent conduct of real estate brokerage, the period of mutual aid agreement to compensate the transaction party for property damage within the limit of the subscription amount, which was incurred to the transaction party, and the period of mutual aid agreement to maintain it by not later than the expiration of the period of mutual aid agreement on January 14, 2011.
5) On January 18, 2010, Defendant E also concluded a mutual aid agreement with the Defendant Association on the said contents, and then renewed the period of mutual aid every one year and maintained it by the date of reporting the closure of business. (b) On May 21, 2012, F leased No. 506 of the G building to J on May 21, 2012, and its lease deposit is KRW 50 million.
