A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No person other than a pharmacy founder, may sell or acquire medicines for the purpose of sale;

The Defendant, along with his father C (the disposition of suspending indictment), conspireded to sell the above medicine, etc. to Chinese consumers through "D", when purchasing prescription drugs and over-the-counter drugs using the fact that the above C is a doctor.

Around June 19, 2013, the above C acquired drugs for the purpose of selling at KRW 40,973,020 from June 19, 2013 to August 12, 2014, including the purchase of psychotropic drugs at KRW 158,40,00, which had an effect of drinking suppression from the Guro-gu Dispute Resolution Co., Ltd., for the purpose of selling at KRW 40,973,020. The Defendant posted drugs acquired in the above Internet shopping mall for the purpose of selling them, and received orders through online hosting counseling, and delivered the said drugs using international post office international services, around June 21, 2013, by selling at KRW 145,920,00, which mixed the Memera and the Mesule to E, from around June 21, 2013 to around June 6, 2014, including the sale of KRW 145,920,709, Jul. 6, 2019, 2013

As a result, the Defendant conspired with the above C to sell drugs even though it is not a pharmacy founder.

2. Single-use;

(a) No person, other than a pharmacy founder, may sell or acquire drugs for the purpose of selling them;

Nevertheless, on September 23, 2013, the Defendant, other than a pharmacy founder, purchased 4 kinds of over-the-counter drugs for the purpose of sale, including Huzidine and Huzzin from G Pharmacy located in Dongdaemun-gu Seoul Metropolitan Government, etc., and sold 7,200 won of Huzidine and 4 items of Huzin from August 31, 2013 to August 19, 2014, through Internet shopping mall operated by himself/herself, as shown in attached Table 2 of the List of Crimes.
