1. The judgment of the court of first instance is modified as follows.

A. (1) In a case where a vehicle is damaged due to an accident, if the cost required for the repair of the vehicle considerably exceeds the exchange price of the vehicle, it is generally deemed impossible to repair in an economic aspect and only the remainder calculated by deducting the scrap metal from the exchange price at the time of the accident can be claimed as compensation for damages. However, if there are special circumstances that make it possible to recognize repair of the vehicle in light of ordinary social norms, it shall be deemed that the total amount of the repair cost can be recognized as the amount of compensation for damages, in light of ordinary social norms.
(2) On the other hand, among automobiles appropriated for a license, registration, increase in the number of automobiles, or scrapping of automobiles for passenger transport service, the term of appropriation is one year (Article 84(2) of the Passenger Transport Service Act and Article 40(4) of the Enforcement Decree of the same Act). The defendant must purchase a new passenger car for less than one year in the event of scrapping of the defendant vehicle for which 29 months have elapsed at the time of the accident in this case. (2) The defendant vehicle's acquisition price is 13,215,907 won (excluding additional tax) with a general passenger car which is not a LPG vehicle, and the market price is 10,50,500,00 won to 11,50,500,000 won to 11,50,000 won, while the replacement price of the vehicle in this case exceeds the replacement price at the time of the accident in this case.
