The prosecutor's appeal is dismissed.

1. According to the evidence submitted by the prosecutor of the gist of the grounds for appeal, the fact that the defendant deceivings the victim with the intent to commit fraud can be acknowledged.

Nevertheless, the court below found the defendant not guilty and erred by misapprehending the facts and by misapprehending the legal principles.

2. Examining the evidence duly adopted and examined by the court below and the court below in light of the records, it is just to conclude that the court below found the defendant not guilty of the facts charged of this case on the grounds of its stated reasoning, and there is an error of law by misunderstanding facts or by misapprehending legal principles as alleged in the prosecutor's appeal, as otherwise alleged in the grounds of appeal by the prosecutor

Therefore, the prosecutor's above assertion is without merit.

3. The appeal by the prosecutor of the conclusion is without merit and is dismissed in accordance with Article 364(4) of the Criminal Procedure Act. It is so decided as per Disposition.
