1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. The Defendant is a company operating satellite broadcasting service business, etc., and the Plaintiff is a person who joined the Defendant company on September 10, 201 and served until September 23, 2014.
B. On April 1, 2013, the Plaintiff entered into a management agreement with the Defendant with the term of contract from April 1, 2013 to March 31, 2016, with the head of the management support center (class: Standing) that the Plaintiff would have worked as the head of the Defendant’s management support center (hereinafter “instant employment contract”). The Defendant abolished the management support center on April 1, 2014 while implementing reorganization. On the same day, the Plaintiff issued a standby order to the Plaintiff as a planning member on the same day, but issued the Plaintiff on July 1, 2014, and the Plaintiff submitted to the Defendant on September 17, 2014, resignation to the effect that the Plaintiff would resign from the Defendant as of September 24, 2014, and the Defendant dismissed the Plaintiff as of September 24, 2014.
C. Upon receipt of a standby order from April 1, 2013 to April 1, 2014, the Plaintiff received KRW 120,000,000 annual salary from the Defendant under the instant employment contract (i.e., basic pay of KRW 85,000,000). From January 2014 to March 2014, the Plaintiff received KRW 10,425,558 as the piece rate payment from January 7, 2014, and received KRW 145,487,480 in total as follows for the settlement of retirement payment.

D. Meanwhile, on October 10, 2014, the Plaintiff filed a petition with the Seoul Western District Office for the payment of unpaid wages and retirement allowances against the Defendant, and the Seoul Western District Office of the Seoul Western District Office requires the Defendant to additionally pay the Defendant the amount of KRW 13,459,406 at a position from April 1 to September 23, 2014, and the amount of KRW 10,425,558 at piece rates from April 1 to March 31, 2014, and the amount of KRW 149,920 unfairly deducted retirement allowances from January 27, 2015.
