1. The Plaintiff:
A. Defendant C’s KRW 169,049,190 as well as 5% per annum from March 11, 2016 to July 10, 2017.
Reasons
1. Determination as to each claim against Defendant A, B, and D
A. On May 13, 2015, the Plaintiff is a gas station located in Pyeongtaek-si E (hereinafter “instant gas station”) to Defendant A as the broker of Defendant D on May 13, 2015.
(2) Defendant A operated the instant gas station from May 27, 2015 to May 31, 2017, respectively, with the term of contract from May 13, 2015 to May 31, 2017; and (3) Defendant A operated the instant gas station from May 27, 2015 to the name of “F gas station”; Defendant B was in the position of the head of the instant gas station; Defendant C operated the instant gas station together with Defendant A.
3) On June 18, 2015, as a result of the joint control between the Yong-Nam headquarters of the Korea Petroleum Quality & Distribution Authority and the Pyeongtaek-gu Police Station, a decision was made on the conformity of fake petroleum and quality with the petroleum sold at the instant gas station. As a result, a disposition of business suspension was rendered for nine months (from August 25, 2015 to May 24, 2016). Upon filing an administrative lawsuit against the aforementioned disposition, the Defendant A filed an application for the suspension of business suspension and filed an application for the suspension of business suspension on September 18, 2015. (iv) On January 16, 2016, the Korea Petroleum Quality & Distribution Authority installed and remodeled the business facilities (Pipe) in the instant gas station and subsequently revoked the registration of the instant gas station from March 11, 2016 to March 31, 2016.
5) At the time of detection of the fact that each of the above fake petroleum sales was discovered, Defendant B was selling petroleum in the instant gas station with the position of being a gas station in the instant gas station, and in particular, at the time of detection on January 27, 2016, Defendant B installed piping pipes and sold fake petroleum by adjusting valves. 6) In order to remove the destruction caused by fake petroleum stored in the instant oil tank, the cost of KRW 1,5520,00 is required.
