Reasons
Punishment of the crime
A person who has failed to name (C): (a) made an unspecified victim call to the investigative agency, misrepresent himself/herself, and withdraw cash on the grounds of leakage of personal information, opening a bankbook, etc.; and (b) acquired it by deceit; and (c) Defendant B, upon the recommendation of the above person who has failed to name, participated in the Bosing Organization and collected cash from victims, performed a role in collecting cash from victims by taking part in the Bosing Organization.
Defendant
B, on November 28, 2018, on the part of the hotel in danger of China, written a letter to the effect that “a person is found to have a large amount of money,” and reported it to the effect that Defendant A, who contacted the Defendant A, would receive money from customers as a private transfer agent, and would receive 2% of the amount received,” and Defendant A consented thereto.
In addition, on November 29, 2018, the person under whose name the person under whose name the statement was omitted ordered the defendant A to go to Daejeon, sent a forged official door in the name of the Chairperson of the Financial Services Commission to the defendant A who had arrived at the discharge from Daejeon by e-mail, and ordered the defendant A to output 20 copies of the forged official door in knife. According to the instructions, the defendant A printed out 20 copies of the forged official door in knife and waiting for the addition of the above person under whose name the person under whose name the statement was rejected.
On November 29, 2018, the above name-freeist called "B is Seoul Central District Prosecutor E., and since the presidential passbook was opened under the name of the party, he/she must prove the damage of other victims. He/she withdrawn 40 million won from his/her corporate bank account and delivered the said money to the F. agent of the Financial Supervisory Service who is traveling to Daejeon."
In fact, however, there was no opening of a passbook in the name of the victim.
