1. On June 9, 2017, the Defendant’s disciplinary action against the Plaintiff for three months of salary reduction shall be revoked.
2. The costs of the lawsuit are assessed against the defendant.
Reasons
1. Details of the disposition;
A. From April 3, 2014 to February 21, 2016, the Plaintiff, while working as the head of the urban planning division of the City Housing Bureau in B City from April 3, 2014, performed overall control over the affairs of formulating an urban management plan to change the total of 3,858,953 square meters of preservation and production management area (385 blocks) to a planned management area.
B. In carrying out the aforementioned tasks, the Plaintiff prepared a strategic environmental impact assessment report with a content that alters the said 385 block to a planned management area, and completed the procedures for consultation with the Han River Basin Environmental Office (hereinafter “Korea River Basin Office”). Ultimately, on July 10, 2015, the Han River Basin Office notified on 22 blocks including 103 and 105 block (the sum of the block; hereinafter “the instant block”) to maintain the current specific use area for the total of 22 blocks including the Han River Basin Environmental Management Office.
C. On July 22, 2015, the Plaintiff: (a) maintained the current specific use area of 20 blocks; (b) prepared a proposal for modifying the urban management plan to the effect that the instant block, which is the remaining block, is changed to a planned management area; and (c) attended the B City Urban Planning Committee held on July 22, 2015 as an executive secretary and presented it for deliberation by the Urban Planning Committee; and (d) deemed that the content of consultation with the Han River Station, as there is no force, may modify the urban management plan differently from the content of consultation; (b) decided on the original plan; and (c) on August 4, 2015 as the topographical map was announced on August 4, 2015, the modification of the instant
On the other hand, on September 2, 2015, the Han River basin Office urged the notification of the results of reflection of the contents of consultation at the time of B, and the plaintiff, the person in charge, on September 11, 2015, asked the Han River basin Office to notify the results of reflection.
