Defendant shall be punished by imprisonment for a year and six months and by a fine of KRW 1,000,00.

The defendant does not pay the above fine.

Punishment of the crime

On July 13, 2017, the Defendant was sentenced to one year of imprisonment with prison labor for the obstruction of performance of official duties, etc. by the Seoul Western District Court on January 5, 2018. On February 5, 2020, the Seoul Western District Court sentenced the Defendant to eight months of imprisonment for the crime of indecent act by force and the crime of assault by force on June 23, 2020, which became final and conclusive on June 23, 2020.

1. The defendant is a person who is engaged in driving of a vehicle Cwing and Class III cargo vehicle;

On November 05, 2019, the Defendant driven the above cargo without obtaining a driver's license on November 05, 2019, and led to the left turn from the central library to the fire extinguishing bridge.

Since there are frequent traffic of vehicles and pedestrians, and there are private-distance crossings without signal lights, the driver of the motor vehicle has a duty of care to prevent accidents in advance by safely driving the motor vehicle, such as reducing speed to those engaged in driving the motor vehicle, keeping well the right and the right of the driving direction, accurately manipulating the steering and brakes, etc.

Nevertheless, the Defendant neglected this and found the Victim F (the age of 85) who was moving to the right side from the left side by the negligence of leaving it to the left as it is, and then found it late, and had the victim go beyond the floor with the victim's body part above the left side of the said cargo vehicle.

Ultimately, around January 9, 2020, the Defendant caused the victim's death by occupational negligence in the H Hospital located in Gwangju Dong-gu, Gwangju to the pharmaculty of inhaled at the H Hospital located in Gwangju-gu.

2. Violation of the Road Traffic Act (unlicensed Driving) driving of the Defendant, without obtaining a temporary driving license as stated in paragraph (1) of this Article, from the 17 km section to the roads near the Hacheon-si, Haak-gun, the Defendant was driving the Cwing-III truck from the 17 km section.
