피고인은 2018. 11. 10. 21:00경 부천시 E에 있는 피해자의 주거지로 찾아가 피해자에게 “너희 집 문을 열어주지 않으면 가슴사진을 유포하겠다”라는 F 메시지를 보내 피해자를 협박하여 이에 겁을 먹은 피해자가 현관문을 열어주자 집 안으로 들어간 후, 미리 준비해 간 맥주를 피해자에게 마시게 하고, 반항을 하는 피해자에게 강제로 키스를 하고 손으로 피해자의 가슴과 음부를 만지고 손가락을 피해자의 음부에 집어넣고 가슴을 입으로 빤 후, 이어서 피해자를 안방 바닥에 눕힌 뒤 입으로 피해자의 음부를 빨고, 피해자에게 피고인의 성기를 빨게 하고, 피해자의 음부에 피고인의 성기를 삽입하여 1회 강간하였다.

2. On November 10, 2018, the Defendant shall assist the victimized party who was raped in the said victim’s residence in around 21:00.
