Punishment of the crime
[2015 Highest 758] The Defendant is a person who operates a motor vehicle maintenance business headquarters (ju)C.
1. On April 9, 2014, the Defendant committed a crime against the victim D, at the office of the above state office E in Nam-si, Namyang-si, and sold the victim D in a gold amount of KRW 9 million under the condition of repair of the vehicle of the F salary class III and of KRW 31 ton.
On June 11, 2014, the Defendant sold the said vehicle to a third party, and agreed to return the sales proceeds to the third party, and sold the said vehicle to the said G at KRW 8.3 million on the 30th of the same month after delivery of the vehicle from the victim, and embezzled the said vehicle by voluntarily consuming it as industry operating expenses, etc. around that time.
2. Around September 16, 2014, the Defendant, at the office of the said state (C) around September 16, 2014, acted as a broker to purchase the 9.2 million J. J. J. J. 2013 from the victim H, with a view to purchasing KRW 9.2 million from the victim H. The Defendant decided to repair the said vehicle within 10 days after moving the vehicle in the name of the vehicle and deliver it to the victim within 14 million, and was remitted from the victim. While the said vehicle was stored for the victim, the Defendant refused to return the said vehicle without justifiable grounds even though the Defendant requested the victim to return the vehicle from November 5 of the same year.
