1. The Defendant’s KRW 254,646,080 as well as 5% per annum from May 9, 2011 to March 9, 2016 to the Plaintiff.
Reasons
1. Facts of recognition;
A. The Dong Yang Trade Co., Ltd. (hereinafter “Dong Yang Trade Co., Ltd.”) is a stock company that engages in the manufacture, sale, and service business of gas apparatus and related equipment and parts thereof. The Defendant is a person who works as a B employee of the above Dong Yang Trade, from December 1, 191 to April 30, 201, while working as a B employee of the above Dong Yang Trade, who is in charge of business management, request for shipment, and collection management, etc.
B. The Defendant, from around December 10, 201 to April 30, 201, performed the work by inputting the order of the customer and the request for release from the distribution center into the business computer system (SAP ERPR/3) of the same store from around December 10, 2011, was ordered by the other transaction parties. However, as the C company D ordered, the goods were shipped out several times by entering the aforementioned system into the false information system, so that the actual credit price of the C company D and the electronic credit price are different. Accordingly, the Defendant, as seen below, failed to prevent the B from normally collecting the credit price of KRW 8,089,00 on the computerized credit price of the “B” under the name of the same store store, and prevented the Defendant from collecting the credit price of KRW 178,65,008,00 on the computerized credit price of the transaction parties as set out in paragraph (1) of the same Article.
The order from December 10, 201 to April 30, 201, which was received from another customer who is not D in the same dong branch D, shall not be known where the customer who received the goods actually is included in the business computer system in the name of the same dong branch D where the credit limit remains.
b. It is difficult to find out where the transaction partner who actually received the goods is located in the business computer system in the name of E in which the order received from other transaction parties than 8,089,000 won and the credit limit remains.
