1. The defendant shall be the plaintiff.

1. Basic facts

A. On April 10, 201, the Plaintiff entered into a lease agreement with the Defendant, stating that “The building indicated in the attachment (hereinafter “instant building”) as “The lease deposit KRW 10 million, the lease period of KRW 10 million, the lease period of KRW 1 million, the rent of KRW 100,000 per month, and the rent of KRW 10,000,000 per month, and the said building was handed over.”

B. On September 16, 2014, the Plaintiff filed a lawsuit against the Defendant on the grounds of the Defendant’s delinquency in rent or the expiration of the contract term, and received a favorable judgment for non-litigation on September 16, 2014. The said judgment became final and conclusive on October 7, 2014.

C. After that, on October 23, 2014, the Plaintiff again concluded a lease agreement with the Defendant stating that “The instant building is KRW 10 million, the term of lease from October 23, 2014 to November 10, 2015, KRW 13 months, the monthly rent of KRW 100,000,000 from October 23, 2014, and the monthly rent of KRW 100,000,000,000 from November 10, 2015.” The Plaintiff agreed that the Plaintiff may immediately terminate the lease agreement if the Defendant’s overdue rent falls short of the two-year rent.

The Defendant was not paid three months from August 2015 to October 2015, and the Plaintiff notified the termination of the lease contract by means of content-certified mail on October 12, 2015.

E. Since November 3, 2015, the Defendant paid to the Plaintiff KRW 3 million for the rent of KRW 3 million as of November 3, 2015, and KRW 1 million for the rent of KRW 1 million as of January 12, 2016, and for the same year

3. 11.1. Monthly rent of one million won, one million won, and the same year.

4. 11.1. Monthly Rent of KRW 1.0 million, and the same year.

5. 9.1. As of the date of closing argument in this case, the unpaid rent of one million won as of September 1, 2000 shall be two months.

(A) On April 10, 2016, the amount of the rent paid in advance is unpaid from April 10, 2016 (which is the basis for recognition). [The fact that there is no dispute, entry of Gap evidence 1 through 8 (which includes branch numbers; hereinafter the same shall apply) and the purport of the whole pleadings.
