피고인은 2013. 8. 12. 21:50경 자신이 근무하는 식당의 아르바이트생인 피해자 C(여, 19세)을 집에 데려다 주겠다며 자신의 D 렉스턴 차량 뒷좌석에 태운 후 2013. 8. 12. 22:10경 피해자의 집 부근인 전북 완주군 E에 있는 F중학교 앞 도로를 지나던 중 그곳에 차량을 정차하고 “뽀뽀 한번 해보자”라고 말하며 갑자기 뒷좌석에 앉아 있던 피해자의 오른팔을 잡아당긴 후 끌어당겨 입을 맞추고, 피해자가 이를 거부하며 밀치자 다시 차량을 운전하여 진행하다가 집 부근에서 하차하려 하는 피해자에게 갑자기 운전석에서 손을 뻗어 “찌찌도 크네”라고 말하며 피해자의 오른쪽 가슴을 손으로 주물렀다.
