Reasons
Punishment of the crime
The defendant was aware that C, who is the defendant's will of the defendant, left the place of entertainment with the helper, and was under the influence of alcohol while leaving the place of entertainment, and planned to receive the insurance money from the above C by receiving the insurance money after he intentionally paid the traffic accident against C.
At around 02:50 on October 19, 2017, the Defendant: (a) discovered a rocketing car driven by the said C while waiting to leave the said C on the front of the E restaurant located in Yansan-gu, Jeonju-si; (b) followed approximately 4 km up to the road front of the H restaurant located in the said G, and (c) operated the steering gear intentionally on the left side in the course of overtaking the said rocketing car at the said place in the said place; and (d) caused a traffic accident in front of the left side of the said rocketing car, which was received by the said C, and caused a traffic accident in front of the left side of the said rocketing car; and (b) caused a traffic accident to the victim KB, the insurance company to which the C was a member.
The report was filed.
Since then, the Defendant filed a claim for insurance money against the victim KB non-life insurance as if the said traffic accident was an accident by negligence, and received KRW 1,89,000 from the victim KB non-life insurance on October 31, 2017, and acquired KRW 660,870 from the Defendant’s hospital on December 1, 2017, and KRW 300,000 for the Defendant’s injury compensation on December 27, 2017.
