For the reasons indicated in its holding, the lower court determined that the charge of violation of the Narcotics Control Act among the facts charged in the instant case was specified.

Therefore, the judgment of the court of first instance which dismissed this part of the prosecution is judged to be null and void due to the violation of the provisions of law.
