1. The defendant is based on the sale on February 1, 2021 as to the real estate stated in the attached list 1, 2, and 3 to the plaintiff.
Reasons
1. Facts of recognition;
A. On April 2008, an auction procedure for real estate was initiated on April 2, 2008, the G, H, I, and J between E and C, including real estate listed in the attached list, and the forest land of approximately 37 lots (38 pieces excluding F, G, H, I, and J, hereinafter “the forest of this case”). However, the real estate auction procedure was initiated on April 2008, with the failure in the sale business.
B. The Defendant, non-party N,O, and P agreed to jointly contribute funds to receive the successful bid of the instant forest and distribute profits generated from the sale of the forest in accordance with their respective investment ratios. On September 4, 2009, upon receiving the decision to permit the sale of the instant forest and forest under the Defendant’s name, the Defendant acquired the ownership of the instant forest and forest under the Defendant’s name by fully paying the sale price on October 7, 2009.
