A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime

Around July 2011, the Defendant stated that “Around early July 2011, the Defendant would return the full amount of KRW 20 million every month if he/she invests KRW 200 million to the Republic of Korea because he/she is operating a business early from Africa,” and that “Around July 201, he/she would return the investment amount in full 30 days after the date when he/she requests the return of the investment amount.”

However, in fact, even if the defendant received the above money from the injured party at that time, he thought that he will use it for the personal purpose, and there was no clear way to prepare the profit to be paid to the injured party, so there was no intention or ability to pay the profit or return the investment money as promised by the injured party.

On July 27, 2011, the Defendant received KRW 100 million from the damaged party to the Agricultural Cooperative account in the name of the Defendant, and KRW 100 million from the new bank account in the name of the E Co., Ltd., and acquired KRW 200 million in total.

The Defendant, as a joint operator of the FF corporation, whose main business is the importation of fishery products, was to raise funds to use them for the personal investment purpose of the Defendant, was to obtain investments from investors, including victims G, in the name of early livelihood import price, and to acquire them by fraud.

On July 18, 2011, at the F Co., Ltd. office located in Seoul Special Metropolitan City, Nowon-gu H building 405 around July 18, 201, the Defendant is easy to bring the goods into the victim G as there is no money to secure the goods at the present place.

When investing money, a shipment certificate (BL) may be issued by facsimile within one week.

It is possible to make a large amount of money to bring about an article because it is too good and confiscing it.

If 100 million won has been invested, the early importation from Africa shall be 40 days after the shipment.
