1. The plaintiff's claims against the defendants are all dismissed.

1. Basic facts

A. The Plaintiff is a company established for the purpose of housing construction, real estate consulting service business, etc., and D was the representative director of the Plaintiff from July 6, 2008 to June 27, 2013.

B. Defendant C is a company established for the purpose of real estate development lease and sale business, and Defendant C is a person who actually operates Defendant C.

On July 2011, the Plaintiff asserted that: (a) at Defendant B’s request, Defendant C performed the work of preparing a business plan and conducting business review, etc. eight times until May 2012, including preparing a reconstruction project plan; and (b) the service cost was at least KRW 10 million per unit; and (c) Defendant D and Defendant B did not prepare a written contract.

Therefore, the Plaintiff and Defendant B concluded a service contract for Defendant C, which is a third party. As such, Defendant B paid the Plaintiff the service cost of KRW 80 million and the delay damages therefrom. Even if the contract was not concluded for the said third party, the Plaintiff and the Defendant C concluded a service contract implicitly between the Plaintiff and the Defendant C, so Defendant C shall pay the above service cost and the delay damages to the Plaintiff.

3. Each of the written evidence No. 2 and the testimony of the witness F was concluded between the Plaintiff and the Defendant B with respect to the service contract for the Defendant C, a third party.

The plaintiff's assertion is without merit without any need to further examine the service cost, since it is insufficient to acknowledge the fact that the service reservation was made implicitly between the plaintiff and the defendant C, and there is no other evidence to acknowledge it.

4. Conclusion, the plaintiff's claim of this case is dismissed as it is without merit.
