1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Summary of the plaintiff's assertion
A. On November 22, 1991, 191, the Defendant’s father-gu’s father owned the instant land 681 square meters (hereinafter “instant land”). The Defendant’s mother-child deceased on August 14, 1992, completed the registration of transfer of ownership under his name on the ground of the division of inherited property. On March 14, 2006, E died on May 4, 201, the Defendant completed the registration of transfer of ownership on the instant land under his name on the ground of the division of inherited property.
B. Meanwhile, around 1977, F: (a) constructed a toilet building on the ground surface of 64m2 in the ship, which connects each of the items in the annexed drawing No. 1, 2, 3, 4, and 1 among the instant land, in the order of order, and connects each of the items in the attached drawing No. 1, 15, 16, 17, 18, and 15 on the ground surface of 15m21m2; and (b) around that time, F set the instant land as “three-year rice end” and “after each year’s end” and “after each year’s end.
C. Thereafter, around December 7, 2002, G purchased each of the above buildings from F in the amount of KRW 4,50,000, and around that time, G constructed a new building for warehouse on the land of KRW 51 square meters on the ship which connects each of the following points in the attached drawings 5, 6, 7, 8, and 5 among the land of this case to the area of KRW 24 square meters on the ground of Annex 1 drawing.
On July 28, 2003, the Plaintiff purchased from G the above building for housing, vinyl structure, warehouse building, and toilet building (hereinafter “the instant building”) from G to 8,000,000,00. From that time, the Plaintiff occupied and used the instant building and other buildings including the instant building from around that time to that time, and occupied and used the instant building and other buildings, and occupied the portion (A) 264 square meters of the instant building among the instant land (hereinafter “the instant building site”).
E. However, there is a problem.
