1. The Defendant shall pay to the Plaintiff KRW 26,13,00 and the interest rate of KRW 15% per annum from March 10, 2016 to the date of complete payment.

Basic Facts

The plaintiff is a person who provides human resources dispatch service under the trade name of "C".

The defendant is a company established for the purpose of soil construction business.

The Defendant: (a) around September 20, 2015, the construction work for the E-family house in Yeongdeungpo-gu, Young-gu (hereinafter “instant construction work”) was awarded a subcontract by setting the construction cost of KRW 203,50,000 on August 10, 2015 to October 26, 2015; and (b) the construction cost of the instant construction work.

[Grounds for recognition] The Plaintiff supplied human resources equivalent to KRW 26,13,00 at the instant construction site from October 1 to October 29, 2015 upon the Defendant’s request, and thus, the Defendant is obliged to pay the above price.

Defendant did not request the Plaintiff to supply human resources.

Even if not, part of the amount claimed by the Plaintiff is not related to the construction site of this case.

Provided, That the following facts are not disputed between the parties, or may be recognized by taking into account each entry of Gap 1 through 31, 35, 37, and 5, and the whole purport of oral arguments.

① From October 1 to October 29, 2015, the Plaintiff signed the F and G (the Head of Working Group), etc., working at the instant construction site, on the letter of work confirmation by date by the number of copies supplied at the instant construction site from October 1 to October 29.

The plaintiff paid the wages to his father on the day of work.

② The F gave the Plaintiff a name that the Plaintiff printed as a director of the Defendant Company.

F is written in the document No. 5 of this title as the agent of the defendant company.
