피고인은 2015. 11. 9. 23:35 경 피해자 C( 여, 48세) 이 운전하는 D 택시에 탑승하여 부산 수영구 수영 로타리에 있는 부산은행 앞으로 가 던 중, 같은 시 동래구 E에 있는 F 병원 앞을 지나던 위 택시 안에서 사이드 브레이크를 잡고 있던 피해자의 오른손 손등을 원을 그리듯이 손을 돌리면서 더듬고, 손등을 꾹꾹 누르고, 깍지를 끼는 등 피해자의 손등을 만지며, “ 나랑 섹스를 하면 잘 맞겠다 ”라고 말을 하여 피해자를 강제로 추행하였다.
