[Defendant A] The defendant shall be punished by imprisonment with prison labor for one year
However, the above sentence shall be executed for a period of two years from the date this judgment became final and conclusive.
Reasons
Defendant A, B, C, and E are guilty of the crime (Defendant A, C, and E) and the Defendants were the 7th members of the Busan Metropolitan Council and the chairman of the Busan Metropolitan Council.
H On November 7, 2014, sentenced to a suspended sentence of two-year imprisonment for a violation of the Public Official Election Act in the Busan District Court on the grounds of a violation of the Public Official Election Act. On May 28, 2015, the judgment became final and conclusive on May 28, 2015, and became void as Gu Council members and the Speaker.
Defendant
A, at the election of the Speaker of the G Council, who held a public seat due to the above cancellation of H’s qualification, had a mind to provide money and valuables in order to support himself/herself in the competition and election of the Speaker.
1. On November 12, 2014, Defendant B received KRW 5,00,000,000 in cash from A at the J Ssing room located in Busan, as indicated in the following crime list, for the following reasons: (a) the Defendant received a request from A to support for the election of the chairman of the Gu Council; and (b) received a cash of KRW 500,000,000 from A at the G Sing room.
As a result, the defendant received a bribe in relation to his duties and received a contribution of political funds in relation to the election of the chairman of the local council.
The amount of the accepted bribery (unit (unit) at the place of crime No. 500, Nov. 12, 2014, 2014, “the request for support to be elected to the Speaker of the Gu Council” from the Jsing Bank in Busan on or around Nov. 12, 2014, “the request for support to be made to be elected to the Speaker of the Gu Council” was made in exchange for the receipt of cash around 500,000,000 on or around February 14, 2015, the “G Council located in Busan on or around February 14, 2015,” which was “1,000,000,000,000 of the Gsing Bank in Busan on or around April 14, 2015, the old public health clinic’s “3,000,0000,0000,0000
2. On June 18, 2015, Defendant C received KRW 2,000,000 in cash, along with a solicitation, from the G Council parking lot located in the G Council in Busan, to “a request for support to be elected to the Speaker of the Gu Council” from Defendant C.
As a result, the defendant received a bribe in relation to his duties and received a contribution of political funds in relation to the election of the chairman of the local council.
3. Defendant E is located in Busan around November 12, 2014.
