A defendant shall be punished by imprisonment for not less than two years and six months.
The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.
Reasons
Punishment of the crime
From about 10 years to around 12 years to neighboring houses, the defendant knew of the victim C (math, 12 years of age) and about 10 years to neighboring houses, and the entire family members are friendly with each other, and the defendant was able to grow together, and she was living together.
1. Violation of the Act on the Punishment of Sexual Crimes and Protection of Victims thereof (Minor Rape, etc.)
A. On March 2, 2009, when the Defendant was in the second grade of high school, from around 12:00 to around 16:00, the Defendant: (a) completed a church course in the room of the Defendant’s second floor at the Defendant’s house located in Goyang-si, Seoyang-si, the Defendant: (b) induced the victim (at that time nine years of age) who was playing, to “be sentenced to death,” and (c) forced the victim to go out of clothes at the bed and caused the victim to go out of the bed body; and (d) committed an indecent act against the victim under the age of 13 by using a deceptive scheme.
B. From 12:00 to 16:00 on Sundays 12:0, where the date of the above paragraph (a) above is unknown, the Defendant: (a) induced the victim, who was playing in the room of the above Defendant, to be off the clothes from the bed; (b) induced the victim to be off the clothes in the bed; and (c) caused the victim to go away from the bed body; and (d) committed an indecent act against the victim under the age of 13 by fraudulent means by deceiving the victim’s sound part by hand.
C. From July 2009 to August 17:00 of the same year, the Defendant: (a) took a bath with the victim at the second floor toilet of the above Defendant’s house from around 13:00 to around 17:00; and (b) took an elementary school, and (c) caused the victim to be out of her panty and panty; and (d) took a son who is not a son, she saw the victim into a spoke and panty; (b) she spoved the victim into a spoke, and she spodddd the victim’s bath, and she spokeed the victim under 13 years of age by force.
The defendant is during the summer vacation period from July 2009 to August 2009 when it is impossible to identify the date.
