Reasons
1. The reasoning of the judgment of the court of first instance citing this case is as follows, and the reasoning of the judgment of the court of first instance citing this case is identical to that of the judgment of the court of first instance, and thus, citing this as it is in accordance with the main sentence
(1) The reasoning of the Plaintiff’s appeal is not significantly different from the assertion in the first instance court, and in light of the evidence submitted by the first instance court, the fact-finding and judgment in the first instance court are deemed legitimate. The first instance court’s “influence” in Articles 6 and 7 of the 5th and 7 of the first instance court’s “influencesive acts” is not the purpose of the contract itself but the advisory activities related to real estate transactions are incidental to the mediation of real estate transactions, and if the advisory activities are deemed as incidental to such advisory activities are excluded from the brokerage activities subject to the regulation of the Licensed Real Estate Agents Act, a non-licensed real estate agent is allowed to act as a broker for real estate transactions under the name of the non-licensed real estate agent. This is considered to go against the purport of the Licensed Real Estate Agents Act which strictly prohibits real estate brokerage by a non-licensed real estate agent. (5) The Plaintiff voluntarily assessed his act as a “real estate intermediary” after the instant sales contract.
